Sending and responding to cease-and-desist letters with a clear view of the risks
Bringing and defending oppositions and cancellations before the Trademark Trial and Appeal Board
Removing infringing listings, sellers and domain names from online marketplaces
Litigating trademark infringement, trade dress and false advertising claims in federal court
Infringement rarely announces itself. It shows up as a look-alike product on a marketplace, a new pharmacy or practice with a confusingly similar name, a competitor's application at the USPTO, or a demand letter from someone who claims your brand is theirs. We help brand owners respond quickly and in proportion, from a firm letter to litigation.
What we handle
Demand letters. We send cease-and-desist letters that are firm and well supported, and we evaluate and answer letters our clients receive.
Oppositions and cancellations. We oppose conflicting applications, petition to cancel registrations that block our clients, and defend our clients' registrations before the Trademark Trial and Appeal Board.
Online and marketplace enforcement. We address counterfeit and infringing listings, unauthorized resellers, look-alike domain names and impersonating social media accounts.
Infringement and unfair competition litigation. We bring and defend Lanham Act and state-law claims for trademark infringement, trade dress, dilution, false designation of origin and false advertising, including motions for preliminary injunctions.
Settlements and coexistence. When a business solution makes more sense than a lawsuit, we negotiate coexistence, phase-out and settlement agreements that hold.
How we approach a dispute
We start with the facts that decide most trademark cases: who used the mark first, where, and for what goods or services, and how likely customers are to be confused. That analysis shapes whether to send a letter, file at the TTAB, go to court or negotiate. Because our firm also litigates and arbitrates commercial disputes, a matter can move to the courtroom without changing teams.
