The New York State Office of Professional Discipline (“OPD”) appears to have increased enforcement activity involving registered pharmacies found closed or non-operational during unannounced inspections.

Pharmacy owners and supervising pharmacists affected by these inspections may subsequently face OPD inquiries concerning potential professional misconduct. Importantly, the administrative closure of a pharmacy registration does not necessarily end the matter. The circumstances surrounding the pharmacy’s operations may become the subject of a separate professional disciplinary investigation involving both the establishment and the supervising pharmacist.

An OPD investigative request should not be treated as a routine administrative matter. The manner in which the response is framed, and the information submitted to the Department, can materially affect the course of the investigation and potential disciplinary exposure.
