Supervision and Delegation Compliance

MDRXLaw advises medical spas on supervision, delegation and scope-of-practice compliance and represents practices and licensed clinicians in board and agency inquiries. We align medical director agreements, protocols and daily operations with what state law allows.

OUR EXPERIENCE

A medical spa often employs a mix of physicians, nurse practitioners, physician assistants, registered nurses and estheticians or other unlicensed staff. State law determines which procedures each of them may perform, whether a physician must examine the patient first, and what level of supervision is required.

We analyze each service line, including injectables, laser and energy-based devices, chemical peels, body contouring and IV therapy, and advise on who may perform it, under what orders or protocols, and with what documentation. We draft medical director, supervision and collaboration agreements and written protocols that match what actually happens in the practice.

When a complaint or inquiry arises, such as a board investigation of a physician or nurse practitioner, a complaint about a treatment, or an inquiry into an unlicensed provider performing a restricted procedure, we represent the practice and the clinicians. We also represent individual licensees before their licensing boards.

We review consent forms, patient records practices and adverse-event procedures so that the documentation supports compliance if a treatment outcome is ever questioned.
